This notice explains how Baack Software (company number 16237743, registered in the United Kingdom), trading as Baack ("Baack", "we", "us" or "our"), collects, uses and discloses personal information when you visit https://www.baack.co (the "Site"), use our products and services, subscribe to them, or otherwise communicate with us (together, the "Services"). In this notice, "you" and "your" mean any individual whose personal information we process, whether as a customer, a user of the Services, a visitor to the Site or otherwise.
Please read this notice carefully. It should be read together with any terms of service that apply to your use of the Services.
1. Our role
Baack is the controller of the personal information described in this notice: information about visitors to the Site, holders of Baack accounts, and the people we communicate with about the Services.
Baack also provides storage and processing as a service for the businesses that use it. When those customers use the Services to manage their own data and their customers' data (for example, to publish content, personalise experiences or keep customer records), Baack acts as a processor of that data on their behalf, under our agreement with them. Each customer is the controller of its data, and its own terms and privacy notice explain how it uses it. If your information is held in a service built on Baack, please refer to that business's terms or contact it directly.
2. Changes to this notice
We may update this notice from time to time, including to reflect changes to our practices or for operational, legal or regulatory reasons. When we do, we will publish the revised notice on the Site, update the "Last updated" date and take any further steps required by applicable law.
3. Personal information we collect
In this notice, "personal information" means any information that identifies, relates to, describes or can reasonably be associated with you. The personal information we collect depends on how you, or the business you represent, interact with the Site and the Services.
3.1 Information you provide to us
Personal information you submit to us through the Services may include:
- contact details, such as your name, company name, postal address, telephone number and email address;
- subscription and billing information, such as your billing address, the plan you subscribe to and confirmation of payment;
- account information, such as your username, password and security information;
- information about your business and the content you manage through the Services; and
- customer support information, such as the information you include in messages you send us through the Services.
Some features of the Services require you to provide certain information about yourself or your business. You may choose not to provide it, but doing so may prevent you from using those features.
3.2 Information collected automatically
We automatically collect certain information about your interaction with the Services ("Usage Data"), including through cookies and similar technologies ("Cookies") as described in the Cookies section, where Google Analytics is used only with your consent. Usage Data may include information about how you access and use the Site and your account, including device and browser information, information about your network connection, your IP address and other information about your interaction with the Services.
3.3 Information from third parties
We may obtain or process personal information about you from third parties, including partners, vendors and service providers who collect information on our behalf, such as:
- partners whose integrations use the Services to deliver experiences;
- companies that support the Site and the Services;
- our payment processors, which collect payment information (for example, bank account or card details and billing address) to process your payments and provide the products and services you have requested, in performance of our contract with you; and
- providers of email and analytics tools, which may collect information when you open or click on emails we send you or, if you consent to analytics, when you use the Site.
We treat information obtained from third parties in accordance with this notice. We are not responsible for the accuracy of information provided to us by third parties, or for their policies or practices.
4. How we use personal information
We use personal information for the following purposes, on the lawful bases stated:
- Providing the Services: to provide the Services, process payments and manage your subscription, create and maintain your account, and send you notifications about your account and transactions, in order to perform our contract with you.
- Communicating with you and supporting you: to provide customer support and improve the Services, in our legitimate interests in responding to you, providing effective services and maintaining our business relationship with you.
- Marketing: to send you communications about Baack's products and services by email, text message or post. Where the law requires it, we do this only with your consent, which you may withdraw at any time.
- Security and fraud prevention: to detect, investigate and act on possible fraudulent, illegal or malicious activity, in our legitimate interests in protecting the Services and our users.
- Legal and contractual obligations: to comply with applicable laws, enforce our terms of service, and protect or defend the Services, our rights and the rights of our users and others.
If you register an account, you are responsible for keeping your account credentials secure. You should not share your username, password or other access details with anyone. If you believe your account has been compromised, please contact us immediately.
6. Spam protection
Forms on the Site are protected by Google reCAPTCHA, which validates form submissions and helps us distinguish genuine submissions from automated abuse. reCAPTCHA collects information about your device and your interaction with the page. When you submit a form, this information is sent to Google for verification, which may be processed outside the United Kingdom (see "Where we store and process information"). Google's Privacy Policy (https://policies.google.com/privacy) and Terms of Service (https://policies.google.com/terms) apply to that processing. We use reCAPTCHA in our legitimate interests in protecting the Site and our users from spam and abuse.
7. How we disclose personal information
We may disclose personal information to third parties for the purposes described in this notice, including:
- to vendors and other third parties that perform services on our behalf, such as IT management, payment processing, data analytics, customer support and cloud storage;
- to business and marketing partners, to provide services and advertise to you, which use your information in accordance with their own privacy notices;
- where you direct or ask us to, or otherwise consent to the disclosure, for example through your use of social media widgets or login integrations;
- to our affiliates and within our corporate group, in our legitimate interests in operating our business;
- in connection with a business transaction such as a merger, acquisition or insolvency; and
- to comply with applicable legal obligations (including responding to court orders, warrants and similar requests), to enforce our terms of service, and to protect or defend the Services, our rights and the rights of our users and others.
8. Security and retention
We take appropriate technical and organisational measures to protect personal information. However, no security measures are perfect or impenetrable, and we cannot guarantee absolute security. Information you send to us may not be secure while in transit, so we recommend that you do not use insecure channels to send us sensitive or confidential information.
We keep the personal information of our customers, including account and contact details, until the customer's account is deleted. Information we are required to keep for accounting purposes, such as billing and invoice records, is kept for seven years. Data that customers hold on the Baack platform is kept in accordance with the terms of the business using the platform.
9. Where we store and process information
Data held on the Baack platform is stored and processed in the jurisdiction in which the customer's account is legally registered, currently the United Kingdom, and is not transferred outside it. Customers who need their data held in another jurisdiction, such as the European Union, have it stored and processed in that jurisdiction.
The Site uses Google reCAPTCHA to validate form submissions. When you submit a form, the reCAPTCHA data is sent to Google for verification, which may take place outside the United Kingdom. If you consent to analytics, Google Analytics data may also be processed outside the United Kingdom. Where they do, we rely on the safeguards required by UK data protection law, such as the UK Extension to the EU-US Data Privacy Framework or the International Data Transfer Addendum. Google Analytics provides us with insights into how the Site performs; Google Analytics 4 does not store IP addresses.

Depending on where you live, you may have rights in relation to your personal information, including the right to:
- be informed about how we use your personal information;
- access the personal information we hold about you;
- have inaccurate personal information corrected;
- have your personal information erased;
- restrict our use of your personal information;
- receive your personal information in a portable format;
- object to our use of your personal information, including for direct marketing; and
- withdraw your consent at any time, where we rely on consent.
